White Maison de Couture is Mumbai's first concept luxury store providing leading designer products, jewellery and services to You, through Our physical stores and through Our Site (defined below). You (“You” or “End User” or “User” or “Your” or “Buyer” or “Customer”) are required to read these Terms and Conditions (“Terms”) carefully since Your use of https://whitemaisondecouture.com/ and/or the mobile application (“Site”) implies knowledge, understanding and acceptance of all points under these Terms. These Terms become effective upon Your use of the Site and govern the relationship between You and Us. No cancellations or returns shall be permitted on account of such minor variations in the product images.

Product and Pricing Information:

However, errors can occur, and we reserve the right to cancel any order or modify the price of a product at our discretion. In such cases, we will contact you using the email address or telephone number you provided during registration or at the time of placing your order to discuss further instructions. If we have to cancel your order after processing your payment, we will refund the amount back to your credit card or bank account within a specified timeline. Please note that refunds are not applicable to orders made using the Cash on Delivery option.

The prices displayed on our site may include various charges such as supplier product prices, shipping charges, and customization fees (if applicable). Our pricing policy is subject to change at any time, and the final prices of our products will be determined at our sole discretion.



Cancellation by Us:


We reserve the right to cancel any order for any reason at our sole discretion. There may be certain situations that result in the cancellation of an order, such as limited quantities available for purchase, unavailability of cash on delivery at your location (if selected), errors in product or pricing information, or defects in the product. In such cases, we may require additional information or verifications before accepting any order. We will inform you if any portion of your order is cancelled or if additional information is required to process your order. If your payment has already been processed and your order is cancelled, we will refund the amount paid to your account within 5 to 7 working days after receiving your bank account details for the reversal of payment. We do not provide cash refunds at any time. If you have made payment via online mode, you may opt for a chargeback only if we have been unable to reverse the payment to your account within the stipulated timeframe.

Cancellation by the User:


If You wish to cancel your order, You may do so by submitting a cancellation request to Us. We reserve the right to accept or reject such requests at our sole discretion. If we receive a cancellation request within 24 hours of placing the order, we shall cancel the order and refund the entire amount paid by You. However, We cannot process a cash refund under any circumstances. The amount paid by You will be reversed back to your account within 5 to 7 working days of receiving your bank account details for such reversal.


Please note that We will not be able to cancel orders that have already been processed or orders for which cancellation requests are received after the expiry of the 24-hour window. We have full discretion to determine whether an order has been processed or not, and You agree not to dispute our decision in this regard. After the expiry of the first 24 hours after placing the order, You would not be entitled to cancel the order and receive a refund.


In case of payments made via an online mode, You will be eligible for a chargeback only if You have cancelled your order as per these Terms and We have been unable to reverse the monies paid by You to your account within the timeline set out herein.



Customization:


Customization is available for some of our products, but please note that any customized orders will be non-refundable, non-exchangeable, and non-returnable. The basic silhouette of a product cannot typically be changed, but we do accept customizations such as adding a plain sleeve, changing the measurements, or altering the colour. Any embroidery required will be considered as customization and will be on a chargeable basis. Please note that all customization will be subject to availability and specific confirmation.


If you require any customization, please inform us and we will let you know of any associated charges. It's worth noting that any custom-made orders may take longer to produce and therefore may require additional time to be delivered to you.


Please be aware that any alterations will be considered as customizations and will also be subject to availability and specific confirmation. Any fitting issues arising from an erroneous alteration or production error will be rectified by us. However, if the product is altered/customized according to the measurement provided by you, we do not take responsibility for any subsequent fitting issues. If you require additional alterations, we can provide them subject to additional charges and the possibility and timeline for such alterations and the availability of resources at our end.


Please note that any repairs or alterations may be chargeable, and complimentary alteration service is available on non-discounted products only in case the request for alteration has been made within one month of delivery and such product was sold in India. All alterations requested after one month of the date of delivery will be chargeable. Alterations of discounted merchandise will also be chargeable irrespective of the purchase date, value of the product, or type of alteration. We will inform you of any alteration charges after the product has been examined and the details of the alteration shared by you.


Fraudulent Use /Transactions:


To prevent fraudulent activity, we may monitor user accounts and transactions on our platform. Users found to be engaging in fraudulent behaviour or using multiple accounts may face legal action and be held liable for any costs, including the cost of goods, collection charges, and legal fees. We reserve the right to take legal action against such individuals for any breach of these terms or other unlawful acts. If we detect any fraudulent activity, we may immediately delete the account in question and cancel any pending orders without any liability on our part. Please note that we will not be liable for any refunds in such cases.


As a merchant, we cannot be held liable for any losses or damages that may arise due to the decline of authorization for any transaction, as a result of a cardholder exceeding the pre-set limit agreed upon by us and the relevant bank.

Credit Card Details:


As a user of our website, you confirm that any credit card details provided by you for availing of services on the website are accurate, complete, and legally owned by you. You agree to not use any credit card which is not lawfully owned by you. You further agree and undertake to provide correct and valid credit card details to us. We do not share any credit card information provided by you with any third parties, except for fraud verification or as required by law. We do not take any liability for credit card fraud, and the liability for the fraudulent use of a credit card will solely be on you. We recommend that you use a secure internet connection and take all necessary measures to protect your credit card information.

Billing :


The prices of our products and services listed on our website are inclusive of taxes, unless stated otherwise. The tax amount charged will depend on the destination where the order is being shipped. The tax rate applied to the order will be the combined tax rate for both state and local tax rates, in accordance with the shipping address. We reserve the right to collect taxes for shipping charges wherever applicable.

For orders shipped outside the country of origin, we offer free shipping for orders exceeding a certain amount, unless stated otherwise. A flat shipping charge will be applicable on all orders below the minimum amount specified for free shipping, unless stated otherwise. Please note that additional customs duties and taxes may be levied on international shipments, and the customer is responsible for paying such charges.

Cash On Delivery:

  • We offer Cash on Delivery (COD) as a payment option for eligible orders. Please note that COD may not be available in all locations, and we reserve the right to refuse COD payment for any order at our discretion.
  • For COD orders, we will only collect the exact amount printed on the invoice. Our delivery personnel will verify the order details over a call before processing it. If we are unable to reach you after three attempts, the order will be cancelled.
  • Please note that 100% COD may not be available on all orders. In such cases, we may require you to make an advance payment of up to 50% of the invoice value before processing the order.
  • We accept only Indian currency (except for denominations no longer in circulation by the government) for COD payments.

Delivery:


While we make every effort to deliver products to our customers within the expected timeline, we cannot guarantee delivery times as we work with various suppliers, such as manufacturers, designers, distributors, and importers. Delivery times are subject to the availability and delivery of products from our suppliers to us.


Delays in the delivery of products may occur due to unforeseen circumstances such as bad weather, flight delays, political disruptions, production issues, or operational and logistics issues. We shall not be held liable for any such delays, and customers will not be entitled to any compensation or damages on account of such delays.


In the event of an expected delay, we may choose to notify the customer who has made the purchase regarding the same. If a customer purchases multiple products in one order, we may deliver them together, subject to the availability of stock with relevant designers and brands. If we are unable to deliver all products together, we may deliver them in instalments, and each delivery will be considered a separate contract.

If a customer fails to take delivery of goods, we may charge for additional shipping or warehousing costs at our discretion.



To ensure the smooth delivery of products, it is important that You provide accurate and updated delivery information to Us. If You will not be available to receive the product on the specified date, kindly inform our customer experience team of the same and provide any preferences or special instructions.


Our delivery partner will make a maximum of 3 attempts to deliver the product to You. If they are unable to deliver after the third attempt, the order may be subject to cancellation.


Please note that products will only be handed over to You after payment has been made, and any returns or cancellations must be raised separately with our customer experience team. For international deliveries, a porch or door delivery without a signature may be done in line with international shipping standards.


While we provide estimated delivery times, delays may occur due to various reasons beyond our control, such as third-party delivery agencies or statutory clearances during the delivery process.


In some cases, we may be unable to deliver a confirmed order due to reasons such as unavailability of the product, failure of the manufacturer/supplier/designer/importer to deliver the product, or poor quality of the product. In such instances, we will not be liable to provide any damages or monetary compensation.



Force Majeure:


In the event of unforeseeable circumstances or situations that are beyond Our control, such as natural disasters, epidemics, war, acts of terrorism, labour disputes, power outages, transportation failures, governmental actions or any other force majeure event, We shall not be held liable for any failure or delay in the performance of our obligations under these Terms. We shall make every reasonable effort to mitigate the impact of such events on our operations and fulfilment of orders, but we cannot guarantee the same. In such cases, we reserve the right to suspend, delay, or cancel any order or service without any liability to the Users.


Intellectual Property Rights:


The Company respects the intellectual property rights of others and expects the same from its Users. We make all reasonable efforts to ensure that the products listed on our Site do not infringe any third-party intellectual property rights. Any dispute arising out of or in connection with these Terms or the Privacy Policy, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Specific Offer Terms:

Offers or discount codes cannot be combined or used in conjunction with each other. Only one offer or code can be used per transaction.

Sale Purchase Terms (Including EOSS)


Please find below a similar set of terms and conditions for a sale:

  • The sale is applicable only on select products and may not be valid on all products on the website.

  • Discounts offered on the website may not be applicable to products available in physical stores. For products available in stores, sales staff will advise accordingly.

  • There will be no exchange or return of products purchased during the sale.

The cash-back offer is only applicable on select products and will be given in the form of store credit. The store credit can be used for future purchases on the site and is valid for 6 months from the date of issuance.
